The indictment of President Donald Trump's campaign chairman, Paul Manafort, and Manafort's former business associate Rick Gates includes a count of "conspiracy against the United States."

Of the 12 charges in the indictment, issued by a grand jury as part of the special counsel Robert Mueller's investigation, the "conspiracy" charge quickly gained attention amid other charges of tax fraud and money laundering.

The conspiracy charge doesn't have any direct connection to Mueller's investigation into whether the Trump campaign colluded with Russia before the 2016 US election. Rather, it is a general charge stemming from any joint effort to defraud the US and is tied to the allegations involving Manafort's and Gates' money.

More simply, it's referred to a "conspiracy" because the charges involve two or more people.

Notably, the indictment doesn't mention the Trump campaign. It does, however, cite a specific part of the US legal code that covers "conspiracy to defraud the United States."

Here's the relevant text of the statute:

"If two or more persons conspire either to commit any offense against the United States, or to defraud the United States, or any agency thereof in any manner or for any purpose, and one or more of such persons do any act to effect the object of the conspiracy, each shall be fined under this title or imprisoned not more than five years, or both."

According to the US Department of Justice's website, the statute covers activities that "affect the government in at least one of three ways":




    • They cheat the government out of money or property;
    • They interfere or obstruct legitimate Government activity; or
    • They make wrongful use of a governmental instrumentality.
Also cited on the DOJ's explanation of the statute is a decision from former Supreme Court Chief Justice William Howard Taft, who wrote, "To conspire to defraud the United States means primarily to cheat the Government out of property or money."

Taft continued: "It also means to interfere with or obstruct one of its lawful governmental functions by deceit, craft or trickery, or at least by means that are dishonest."

The statute is also listed on the IRS's website under penalties related to general fraud.

George Papadopoulos, an early foreign-policy adviser and aide to President Donald Trump's campaign team, was told that Moscow had dirt on Hillary Clinton in April 2016, newly unsealed court documents show.


The revelation changes the timeline of Russia's efforts to interfere in the US presidential election. The offering on Clinton, in this case, was in the form of "thousands of emails," disclosed to Papadopoulos by a person identified as an "overseas professor."


The professor was later identified by The Washington Post as Joseph Mifsud, director of the London Academy of Diplomacy.

The court document was filed by special counsel Robert Mueller's office in early October. It alleges that Papadopoulos lied to the FBI about the nature and extent of his contacts with foreign nationals and says he knew they had ties to senior Russian government officials.


On October 5, Papadopoulos pleaded guilty to making false statements to federal agents. He now appears to be a cooperating witness in Mueller's investigation of potential collusion between the Trump campaign and Russia. But the revelation that a foreign national tied to Russia offered the campaign dirt on Clinton in the form of emails in April 2016 seems to move up the known timeline of Moscow's election interference.


"On or about April 26, 2016, defendant Papadopoulos met the professor for breakfast at a London hotel," says the special counsel's court filing.


"During this meeting, the Professor told defendant that he had just returned from a trip to Moscow where he had met with high-level Russian government officials. The professor told defendant that on that trip he (the professor) learned that the Russians had obtained "dirt" on then-candidate Clinton. The professor told defendant Papadopoulos, as Papadopoulos later described to the FBI, that 'they [the Russians] have dirt on her'; 'the Russians had emails on Clinton'; 'they have thousands of emails.'"


The document suggests Papadopoulos had known that Russia was actively trying to undermine Clinton before virtually anyone else.


Hackers, believed to be Russian, breached Clinton's campaign chairman John Podesta's email server in March, but those emails were not published by WikiLeaks until October. News that the Democratic National Committee had been breached by Russia-linked hackers in late 2015 did not break until June 14, 2016.


'Putin wants to host the Trump team when the time is right'

The revelation sheds new light on claims made by both the campaign and WikiLeaks, which published the stolen DNC emails on July 22, in the weeks and months leading up to the election.


According to the special counsel's office, Papadopoulos kept trying to organize a meeting between the campaign and Russian government officials even after learning from the professor that Russia was trying to compromise Clinton. He thanked the professor for his "critical help," according to the filing, saying that it would be "history making" if a meeting took place.


Papadopoulos emailed top Trump advisers several times after learning of the emails, but he never said exactly — not in emails, anyway — what the Russian officials wanted to discuss with the campaign.


In an April email to then campaign manager Corey Lewandowski, Papadopoulos said he had gotten "a lot of calls over the past month" about how "Putin wants to host the Trump team when the time is right," according to The Washington Post.


On May 4, he told Lewandowski and campaign cochairman Sam Clovis that Ivan Timofeev, a senior official at the Russian International Affairs Council, wanted them to know that Russian officials were open to Trump visiting Moscow.


Clovis replied that "there are legal issues we need to mitigate, meeting with foreign officials as a private citizen."


But Papadopoulos was not deterred: He sent the same email to Paul Manafort — listed as a "high-ranking campaign official" in the government filing but identified previously in a Washington Post report — on May 21, just after Manafort was named campaign chairman, telling him that "Russia has been eager to meet with Mr. Trump for some time and have been reaching out to me to discuss."


The special counsel's filing indicates that the official forwarded Papadopoulos' email to another campaign official and wrote: "Let's discuss. We need someone to communicate that DT is not doing these trips. It should be someone low level in the campaign so as not to send any signal."


It is unclear whether Papadopoulos had told anyone in the campaign, at this point, about the Russian "dirt" on Hillary Clinton. On June 1, 2016, Papadopoulos again emailed an unidentified "high-ranking campaign official" and asked about Russia, according to the special counsel's office.


The official referred Papadopoulos to the "campaign supervisor," who Papadopoulos emailed with the subject line "Re: Messages from Russia."


"I have the Russian MFA asking me if Mr. Trump is interested in visiting Russia at some point. Wanted to pass this info along to you for you to decide what's best to do with it and what message I should sent (or to ignore)," he wrote.

On June 3, 2016, music publicist Rob Goldstone emailed Donald Trump Jr. and said “The Crown prosecutor of Russia … offered to provide the Trump campaign with some official documents and information that would incriminate Hillary and her dealings with Russia and would be very useful to your *******."


The information, Goldstone said, was "part of Russia and its government’s support for Mr. Trump."


"If it's what you say I love it especially later in the summer," Trump Jr. replied.


Six days later, Trump Jr., Paul Manafort, and Trump's *******-in-law and top campaign adviser Jared Kushner met with Russian lawyer Natalia Veselnitskaya — identified as a "Russian government attorney" in Goldstone's emails — on the promise of dirt on Hillary Clinton.


The Washington Post reported on June 14 that Russia-linked hackers had breached the DNC. Five days later, Papadopoulos again emailed the unidentified "high-ranking" Trump campaign official telling him that he would be willing to travel to Moscow to meet with Russian government officials "if it's in the interest of Mr. Trump and the campaign to meet specific people."


That month, the CEO of the data firm that would soon be hired by Trump's campaign, Cambridge Analytica, reached out to WikiLeaks founder Julian Assange offering to help release the 33,000 emails Clinton said she deleted from her private email server.


It is unclear why the CEO, Alexander Nix, thought that Assange had those emails at the time — there is still no evidence that anyone had obtained them, and WikiLeaks did not publish the first batch of stolen DNC emails until late July.


The trip to Moscow that Papadopoulos was planning, meanwhile, never took place. But Russian sources cited in a dossier compiled by former British spy Christopher Steele say that by late July 2016, there was "a well-developed conspiracy of co-operation between [the campaign] and the Russian leadership," both of which had an interest in defeating Clinton.

On July 7, Manafort offered to exchange briefings about the campaign for debt repayment or cancellation from his contacts in Ukraine and Russia, according to emails reviewed by The Washington Post. Manafort had been a top adviser to Ukraine's pro-Russia Party of Regions from 2004 to 2014.


Asked by ABC's George Stephanopoulos on July 24 whether there were any connections between the Trump campaign and Russia, Manafort replied, "No, there are not. And you know, there's no basis to it."


Julian Assange has insisted that Russia was not the source of the DNC emails it published on July 22, between the end of the Republican National Convention and the beginning of the Democratic National Convention.


By that point, however, Russia-linked entities had already offered the campaign "dirt" on Clinton twice, once explicitly in the form of "thousands of emails." On July 27, Trump said: “Russia, if you’re listening, I hope you’re able to find the 30,000 [Clinton] emails that are missing."


The Steele dossier also said that the campaign agreed to sideline the issue of Russia's invasion of Crimea and interference in eastern Ukraine in exchange for WikiLeaks releasing the stolen emails.


The Trump campaign's national-security policy representative for the Republican National Convention acknowledged in an interview with Business Insider in September that he had given his campaign colleagues the opportunity to "intervene" when an amendment to the GOP's draft policy on Ukraine was introduced in Cleveland last July.


The original amendment, which proposed that the GOP commit to sending "lethal weapons" to the Ukrainian army to fend off Russian aggression, was ultimately altered to say "provide appropriate assistance" before it was included in the party's official platform.


Papadopoulos was still pursuing a Trump campaign-Russia meeting as late as August 15, 2016, when a campaign supervisor told him that he would "encourage" him and another foreign policy adviser "to make the trip" to Moscow "if feasible."


The trip never took place, and Manafort was ****** to step down as campaign chairman four days later amid revelations about his lobbying work for pro-Russia entities in Ukraine.

The man who helped put Mike Pence a heartbeat away from the presidency is now facing federal charges.

Paul Manafort, who was hit Monday with 12 counts tied to alleged financial schemes, pushed for Pence to become Trump's running mate and even managed to talk Trump out of his doubts. As the Trump administration now works to distance itself from Manafort, his Pence pick stands among the best evidence of his impact as Trump's short-lived campaign manager.

Before Trump formally announced Pence as his vice presidential candidate, it was Manafort who made sure it happened, as The New York Times reported last year.

Trump had hesitated to settle on Pence, who was serving as governor of Indiana. Trump was fielding last-ditch appeals from New Jersey Governor Chris Christie, and publicly said he had not made a “final, final decision” until advisers like Manafort reminded him the importance of uniting the Republican Party around conservative Christian values.

CBS News reported Pence was Manafort's "first choice" and Manafort even lied about mechanical problems on Trump's plane to make the soon-to-be GOP nominee stay an extra day in Indiana to get to know Pence. In a phone call, Manafort assured Trump that Pence was the right choice, and made a case that won over the real estate tycoon.

Manafort would later downplay his behind-the-scenes choice, telling the Times later that Trump never seriously doubted Pence.

The decision came during the three months Manafort served as Trump's campaign manager, after advising him earlier in the year. Just a month after the Pence pick, Manafort was out, with reports about his foreign finances and government lobbying creating a cloud around the campaign.

Democrats — and a few Republicans — in Congress have a clear message for President Donald Trump: Don't mess with Robert Mueller.

Concerned that the president may fight back after Mueller's investigation into Russian meddling led to two indictments and a guilty plea for his former advisers Monday, top Democrats laid down a marker for the president, who earlier in the year criticized Mueller and the probe.

"The President must not, under any circumstances and in any way, interfere with the special counsel's work," said Senate Democratic Leader Chuck Schumer. "If he does, Congress must respond swiftly, unequivocally, and in a bipartisan way to ensure that the investigation continues and the truth — the whole truth — comes out."

Virginia Sen. Mark Warner, the top Democrat on the Senate intelligence committee, added, "Members of Congress, Republican and Democrat, must also make clear to the President that issuing pardons to any of his associates or to himself would be unacceptable, and result in immediate, bipartisan action by Congress."

Republicans were less explicit, but many sent a similar message.

"I don't think anybody in their right mind at the White House would think about replacing Mr. Mueller unless there was a very good reason," said South Carolina Sen. Lindsey Graham, a Republican who has been both a critic and a friend to Trump over the last year.

Republican Sen. Bob Corker, a Trump critic, said he "can't even imagine" that Trump would fire Mueller.

The first charges announced by Mueller involved former Trump campaign chairman Paul Manafort and his associate Rick Gates, who both pleaded not guilty. Another former adviser, George Papadopoulos, pleaded guilty to lying to FBI agents when asked about Russian contacts.

While he has refrained so far from publicly criticizing Special Counsel Mueller, Vanity Fair says the President is growing increasingly frustrated and privately lashing out at his own legal team and even *******-in-law Jared Kushner, who some around Trump have described as the "worst political adviser in the White House in modern history."






Trump, meanwhile, has reacted to the deteriorating situation by lashing out on Twitter and venting in private to friends. He’s frustrated that the investigation seems to have no end in sight. “Trump wants to be critical of Mueller,” one person who’s been briefed on Trump’s thinking says. “He thinks it’s unfair criticism. Clinton hasn’t gotten anything like this. And what about Tony Podesta? Trump is like, When is that going to end?”





According to two sources, Trump has complained to advisers about his legal team for letting the Mueller probe progress this far. Speaking to Steve Bannon on Tuesday, Trump blamed Jared Kushner for his role in decisions, specifically the firings of Mike Flynn and James Comey, that led to Mueller’s appointment, according to a source briefed on the call. When Roger Stone recently told Trump that Kushner was giving him bad political advice, Trump agreed, according to someone familiar with the conversation. “Jared is the worst political adviser in the White House in modern history,” Nunberg said. “I’m only saying publicly what everyone says behind the scenes at Fox News, in conservative media, and the Senate and Congress.”


Focusing on the Kushner angle, Trump is reportedly increasingly blaming his *******-in-law for his role in decisions that led to the appointment of special counsel Robert Mueller. In a call Tuesday to former White House chief strategist Stephen Bannon, Trump put blame on Kushner for the part he took in choices to fire former national security adviser Michael Flynn and former FBI director James Comey, Vanity Fair reported.


Roger Stone also recently said Kushner wasn't giving Trump good advice — a sentiment which Trump reportedly agreed with, according to someone familiar with the conversation. Sam Nunberg, a former campaign aide to President Trump who was fired, echoed the statement.


"Jared is the worst political adviser in the White House in modern history,” Nunberg said. “I’m only saying publicly what everyone says behind the scenes at Fox News, in conservative media, and the Senate and Congress."


Meanwhile, former Chief Strategist Steve Bannon is apparently also increasingly concerned that the establishment GOP might jump at the opportunity to "fuck over Trump" by supporting impeachment proceedings. Among other things, Bannon has proposed that Trump hire a more aggressive head lawyer and go on the offensive to "defund Mueller’s investigation or limit its scope."






But these soft-power approaches are being criticized by Trump allies including Steve Bannon and Roger Stone, who both believe establishment Republicans are waiting for a chance to impeach Trump. “The establishment has proven time and time again they will fuck Trump over,” a Bannon ally told me.





In a series of phone calls with Trump on Monday and Tuesday, Bannon told the president to shake up the legal team by installing an aggressive lawyer above Cobb, according to two sources briefed on the call. Bannon has also discussed ways to pressure Congress to defund Mueller’s investigation or limit its scope. “Mueller shouldn’t be allowed to be a clean shot on goal,” a Bannon confidant told me. “He must be contested and checked. Right now he has unchecked power.”





Bannon’s sense of urgency is being fueled by his belief that Trump’s hold on power is slipping. The collapse of Obamacare repeal, and the dimming chances that tax reform will pass soon—many Trump allies are deeply pessimistic about its prospects—have created the political climate for establishment Republicans to turn on Trump. Two weeks ago, according to a source, Bannon did a spitball analysis of the Cabinet to see which members would remain loyal to Trump in the event the 25th Amendment were invoked, thereby triggering a vote to remove the president from office. Bannon recently told people he’s not sure if Trump would survive such a vote. “One thing Steve wants Trump to do is take this more seriously,” the Bannon confidant told me. “Stop joking around. Stop tweeting.”


So what comes next: is the end nigh for the Trump administration, torn apart by internal strife and intrigue, especially if it fails to pass tax reform, or will the administration simply slam Vanity Fair's reporting - as Bannon did three weeks ago after the publication reported that the former chief strategist had lost faith in Trump's ability to complete his current term - and press on (with or without Kushner)? And how will Mueller's probe impact any/all of this? We look forward to the answer, knowing that no matter the final outcome, stocks will simply keep grinding to new, record highs.

Citing an unnamed “source familiar with the matter” who is “familiar with Sessions’ views,” NBC, tracking reporting from a number of other outlets, reports that Sessions “rejected a proposal by a junior campaign aide who offered to use his ‘Russian contacts’ to try to set up a meeting” between Trump and Putin. There’s a good reason why Sessions is suddenly trying to jog his memory about the conversation — there’s lots of evidence it occurred, but Sessions repeatedly testified under oath that nothing of the sort did. ...

I think a lot of them are counting on a pardon...but not sure how far the public or congress will let him use that!
