the key word there is MAYBE!
no one just follows the constitution...little hard since the people who wrote it aren't around to ask...…..so like any case in any court....it is what THAT person thinks it means!
so knumbskull if you go back and look at his past rulings you get an idea of how he is going to rule!
sorry I didn't use crayons so it would be easier to understand...….but that's the jist of it
here is one:
Supreme Court nominee Brett Kavanaugh could deal death blow to Obamacare
With the
nomination of Judge Brett Kavanaugh to the Supreme Court, President Donald Trump has now engaged all three branches of government in his fight to get rid of the Affordable Care Act and protections for people with pre-existing health conditions.
Kavanaugh made clear last year in a speech at the
Heritage Foundation that he thinks the court was wrong to uphold the ACA's insurance mandate as constitutional. He has also said a president should be allowed to
not enforce components of a law if he personally deems it unconstitutional (encouragement this president doesn’t need). There couldn’t be a more in-your-face threat to the ACA than from a Justice Kavanaugh.
In pursuit of his goal to ******* the ACA, Trump first tried Congress — making repeal the principal thrust of his first year in office. But legislators pay attention to popular opinion. And provisions that guarantee coverage for people with medical conditions and offer Medicaid to millions of lower income Americans turned out to be immensely
important to the public. At least for this Congress, the legislative route to repealing the ACA
failed.

Kavanaugh’s Labor, Employment Rulings Would Mostly Echo Kennedy
U.S. Supreme Court nominee Brett Kavanaugh would likely continue Justice Anthony Kennedy ‘s legacy of siding with the conservative justices in labor, employment, and benefits cases, though he may diverge from his predecessor’s views on gay bias.

Brett Kavanaugh Ruled Against Workers When No One Else Did
In 2005, a group of workers at a meatpacking plant in Brooklyn voted to join a union. Their employer, a kosher meat wholesaler called Agri Processor, fought the organizing effort as best it could. Once the workers were unionized, the company refused to bargain, arguing that most of them weren’t covered by collective bargaining law because they were undocumented immigrants.
Ultimately, neither the National Labor Relations Board nor the majority of judges on a panel for the U.S. Court of Appeals for the District of Columbia Circuit agreed with Agri Processor. The only one who did was
Brett Kavanaugh, the circuit judge who
wrote a dissent in the case and is now President Donald Trump’s
nominee to replace Justice Anthony Kennedy on the
Supreme Court.
